Personal information you disclose to us

In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.
Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include: your email address, your settings and preferences in our Services (such as email settings and alerts), and authentication data. If you contact us, we also receive your name, if you give it, and your message. We use passwordless authentication via magic links. We do not collect, process, or store user passwords. You must provide your email address to create an account; without it, we cannot provide features that require an account. Other information you give us is optional.
Sensitive Information. We do not intentionally collect sensitive information from you. Public records published in some of our Services may contain such information; see Section 18.
Payment Data. If you buy a subscription, payment is handled by Stripe. Link, Stripe's payment service, acts as the seller and issues the invoice. Stripe collects your card details and billing address and processes them as an independent controller under its own privacy notice at stripe.com/privacy. We never see or store your card number. We receive the email address used for the purchase, your subscription status, plan, billing country, and renewal dates.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not directly identify you by name but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
Like many businesses, we also collect information through cookies and similar technologies.
The information we collect may include:

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION?

In Short: We process personal information only where the GDPR gives us a legal basis. Below, we list each purpose, the legal basis we rely on, and how long we keep the information.

We rely on these legal bases: performance of our contract with you (Art. 6(1)(b) GDPR); our legitimate interests, where your interests and fundamental rights and freedoms do not override them (Art. 6(1)(f)); your consent (Art. 6(1)(a)); and compliance with a legal obligation under EU or Member State law (Art. 6(1)(c)).
Where we rely on legitimate interests, you can object at any time (see Section 12). Where we rely on consent, you can withdraw it at any time without affecting processing that took place before you withdrew.

5. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

In Short: We are not responsible for the safety of any information that you share with third parties that we may link to.
The Services may link to third-party websites, online services, or mobile applications that are not affiliated with us and which may link to other websites, services, or applications. Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third-party websites. Any data collected by third parties is not covered by this Privacy Notice. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions.

6. DO WE USE COOKIES AND SIMILAR TECHNOLOGIES?

In Short: We use cookies and similar technologies that the Services need to work and to remember your preferences. We do not use advertising or tracking cookies.
We use the following:

7. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?

In Short: We may offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.
As part of our Services, we may offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. This Privacy Notice explains how we process personal information when you use AI Products.
All personal information processed using our AI Products is handled in line with our Privacy Notice and our agreement with third parties.
When you use our AI features, the text you enter is sent to our AI provider, OpenAI, to produce a response. We are the controller of this text, and OpenAI processes it on our behalf. Under OpenAI’s API terms, it does not use data sent through its API to train its models by default, and it may retain that data for a limited period to monitor for abuse. Please do not enter personal information, including information about your clients. We do not use your personal information or the text you enter to train AI models. Some Services publish content written by AI.

8. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.
We are based in the United States, and most of our service providers process data there, with some processing in the European Union. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information, in the United States, and other countries.
If you are a resident in the European Union (EU), then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.
Where we transfer personal information from the EU to a country without an adequacy decision, we rely on the EU–US Data Privacy Framework where the recipient is certified under it, and otherwise on standard contractual clauses approved by the European Commission.

9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). We retain your email address and account data for as long as your account is active. Upon account deletion, we will delete or anonymize your personal data within 30 days, except where we need to keep limited information to comply with the law, prevent fraud, resolve disputes, or enforce our Legal Terms.
Some Services send what you type, such as a search query, to our AI provider to produce a response. We use it only to produce that response and do not store it on our servers. As described in Section 3, the text you type may appear in our hosting providers' technical logs and may be retained by our AI provider for a limited period to monitor for abuse. Where a Service keeps a result for you on our servers, it keeps only the result we generated, never the text you typed. Some Services keep your recent searches or results in your browser. Results stored on our servers are deleted when you delete your account. Feedback and reports you send in our apps use fixed options, not free text.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

11. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 years old. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us.

12. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your state of residence in the US or in some regions, such as the European Union (EU), you have rights that allow you greater access to and control over your personal information.

Withdrawing your consent. If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us.

Opting out of marketing and promotional communications. You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.
Account information. If you would at any time like to review or change the information in your account or terminate your account, you can:
Upon your request to terminate your account, we will delete your account and information from our active databases. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services.

13. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. These signals are meant to stop tracking across websites, the sale of personal information, and targeted advertising. We do none of these. We do not use advertising or tracking cookies. Your right to object. If you are named in a source we publish and the GDPR applies to you, you have the right to object to our processing of information about you, and to ask us to correct or erase it. Contact us at support@hjartdalstudios.com and we will assess your request.
